Terms and conditions — DRAFT under review
Version bozza-2026-10-14
DRAFT FOR LEGAL REVIEW — version bozza-2026-10-14. This text is not final and has no legal effect yet. The Italian version prevails.
1. Who we are and what these terms cover
The Restaurant OS website and apps ("the service") are run by [RAGIONE SOCIALE / COMPANY NAME], registered office [INDIRIZZO SEDE LEGALE / ADDRESS], VAT no. [P.IVA], PEC [PEC] ("we"). These terms govern customers' use of the service: finding venues, booking a table, buying experience tickets, writing reviews and managing an account. Personal data is covered by the Privacy notice, cookies by the Cookie policy.
2. Our role
The service connects you with restaurants. The contract for the meal or the experience is between you and the restaurant, which is responsible for it. [INTERMEDIARY / COLLECTION AGENT ON THE RESTAURANT'S BEHALF — TO BE DEFINED WITH COUNSEL]. Prices, menus, opening hours, cancellation rules and deposits are set by each restaurant and shown before you confirm.
3. Account and acceptance
You can browse without an account. We ask you to identify yourself only when you send a booking, buy a ticket or write a review: with e-mail and password, with a link or code sent by e-mail, or with Google or Apple. By creating an account, or by signing in with Google or Apple after reading the line "By continuing you accept the Terms and acknowledge the Privacy notice", you accept the version of these terms in force at that time. We record which version you accepted and when. If the terms change materially we will ask you to accept the new version before you continue. You must be at least [MINIMUM AGE] years old. You are responsible for the accuracy of the data you give and for keeping your password secret. You can close your account at any time from your profile.
4. Bookings
- A booking is confirmed when the site shows it as confirmed or you receive the confirmation; some venues confirm manually and the request stays pending until they reply. - You can add an occasion, special requests and allergies or intolerances. We pass them on to the restaurant, which alone is responsible for how it takes them into account: always tell the staff about serious allergies too. - You can cancel or change a booking from your account. Cancellation is free until the deadline set by each venue (e.g. a number of hours before the time) and shown before you confirm; after that the venue's rules apply. - If you do not show up or arrive very late the venue may release the table.
5. Deposits and payments
Some venues ask for a deposit or prepayment. The amount and refund rules are shown before you pay. Payments are processed by Stripe; we never see your card details. If you cancel within the free-cancellation window the deposit is returned under the venue's rules; after the deadline or if you do not show up it may be kept. [LEGAL NATURE OF THE DEPOSIT, WHO COLLECTS THE PAYMENT AND TAX RECEIPTS — TO BE DEFINED].
6. Experience tickets
- A ticket is valid for the experience, date and number of people shown. - You can request a refund from your account until the deadline set for that experience (a number of hours before it starts). After the deadline the ticket is not refundable, unless the restaurant cancels the experience, in which case we refund you in full. - You can transfer the ticket to another person from your account until the experience starts. After the transfer the ticket is no longer yours. - [EXCLUSION OF THE RIGHT OF WITHDRAWAL FOR CATERING AND LEISURE SERVICES ON A SPECIFIC DATE, Art. 59(n) Italian Consumer Code — TO BE CONFIRMED WITH COUNSEL].
7. Reviews
- You can review a venue after a visit booked through the service. - The review is public immediately, with your name as we display it (e.g. first name and initial). - You can edit it for 48 hours after sending it, but no longer once the venue has replied. - The restaurant may reply and may hide a review from its page. [MODERATION AND DISPUTE CRITERIA AND PROCEDURE — TO BE DEFINED, including under consumer law on reviews]. - Only write about real experiences of your own. Offensive, discriminatory or defamatory content, third parties' personal data, advertising and paid reviews are not allowed. - You grant us a free, non-exclusive licence, for as long as the review is published, to show it on the service and on restaurant pages. [SCOPE OF THE LICENCE — TO BE DEFINED].
8. Ads and sponsored content
Some results and spaces are sponsored by restaurants and are always labelled as such. You can ask to see an ad less. How we process data for ads is explained in the Privacy notice and the Cookie policy.
9. Fair use
You may not: make fake bookings or bookings in someone else's name without their permission, resell tickets for profit [TO BE CONFIRMED], use automated systems to scrape data or book, or bypass security measures. We may suspend or close the account of anyone who breaks these rules, warning them first where possible.
10. Liability
We do our best to keep the service running and venue information accurate, but that information comes from the restaurants. To the extent permitted by law we are not liable for the service provided by the restaurant. Your rights under consumer law and any liability that the law does not allow to be limited are unaffected. [LIMITATION CLAUSES — TO BE ASSESSED WITH COUNSEL].
11. Changes to the service and the terms
We may change the service and these terms. Each version has a number and a date; you will be asked to accept material changes before you continue using your account.
12. Complaints, governing law and jurisdiction
For support and complaints write to [EMAIL ASSISTENZA / SUPPORT E-MAIL]. These terms are governed by Italian law. If you are a consumer, the courts of your place of residence or domicile have jurisdiction, and you keep the protection of the mandatory rules of your country of residence. [JURISDICTION FOR NON-CONSUMERS — TO BE DEFINED]. You may also use an alternative dispute resolution (ADR) body. [ADR BODY — TO BE DEFINED].
